Living Trust Attorney for a Walnut Creek Trust Update

A trust signed decades ago may no longer describe your family, assets, or available successor. Review the full history and current ownership before adding another amendment.

Review the old instructions against today’s life

An older trust can contain useful planning while leaving questions about changed beneficiaries, deceased trustees, or unfunded assets. The Andrews Law Firm can discuss California trust reviews from Truckee, subject to availability. Age alone does not determine whether a trust needs an amendment, restatement, replacement, or another kind of follow-through.

What we can help you plan, review and resolve.

Review your living trust
01

Reconstruct the history

Identify the operative trust and missing versions.

02

Review appointments

Choose people who can serve now.

03

Confirm present funding

Check assets acquired or changed over time.

Find the complete operative document

Gather the original trust, amendments, restatements, schedules, and related estate documents. Identify gaps and conflicting copies instead of selecting whichever binder looks newest. Note whether the trust makers are living and any events that may affect the ability to change provisions. A review should determine the current legal framework before drafting another change. Informal notes may explain wishes but should not be assumed to amend the trust properly. Explain what you want now and identify the instructions that no longer fit, with the relevant documents available for comparison.

Review what changed after the first spouse died

An older joint trust may require a different analysis after a death than while both trust makers are living. Bring the complete trust, amendments, death information, and any administration records before asking to change beneficiaries or assets. Do not assume the surviving person may amend every provision simply because the binder remains at home. The relevant terms, ownership, and applicable law need review. Explain any distributions, retitling, or tax work already performed. This allows the assessment to distinguish a routine current planning update from questions arising from an earlier administration, with the actual documents available rather than an abbreviated family summary.

Refresh the people and practical roles

A trustee chosen many years ago may have died, moved, become unable to serve, or developed circumstances affecting the appointment. Review successors and backups alongside current beneficiaries. Consider who can manage records, communicate with family, and make decisions within the trust’s terms. If the same person also serves under a financial power, confirm that those documents work together. Health care directives require separate attention. The review should avoid assuming that updating one list of names automatically updates every role across the estate plan.

Check funding against transactions since the last review

Obtain the current Contra Costa County deed and account ownership information. A home purchase, refinance, new account, sale, or rollover may have changed the asset picture after the trust was signed. Compare those records with the intended trust ownership and beneficiary designations. Signing a new restatement does not itself complete every funding task. Identify the action needed for each asset and how completion will be documented. Retirement assets and other specially governed benefits should not be casually retitled just to make a checklist appear uniform.

Complete the update as a coordinated set of tasks

Ask how recommended document changes, execution, recording, institutional follow-up, and record access will be handled. A pour-over will can provide a backstop for omitted assets without guaranteeing probate avoidance. Keep only a clearly organized record that identifies the operative documents while retaining the history needed for legal purposes. Discuss future review triggers with the chosen successor. A major family or asset change may matter more than the number of years since signing; the goal is a current, funded plan rather than a new cover page on unresolved ownership questions.

As grieving parents of our deceased son, we were in need of guidance with regard to what do we do next. Our son was without a will and, we had no experience with how to proceed. Luckily, we contacted Elane at the Andrews Law Firm Truckee who immediately understood our situation and was able to provide the information we needed and the necessary legal paperwork to resolve our problem. Our problem was magnified by the fact that we live in Milwaukee and involved my son's car for which we could not find the title. Rather than have to return to Truckee after 40 days to request a new title, Elane assisted us in creating a power attorney for a friend in Truckee which negated our having to return to Truckee from Milwaukee to simply apply for a new title. We are very appreciative with the help we found at The Andres Law Firm Truckee. Thank you, Elaine!

Frequently asked questions

Questions about review the old instructions against today’s life

Can I simply cross out the old trustee and write a new name?
Do not assume a handwritten change is effective. The trust’s terms and applicable execution requirements need review before making amendments.
Is a restatement the same as funding the trust?
No. Updating the governing document and completing ownership or beneficiary steps are separate tasks that should be coordinated.
