  4. 9 months

Federal estate tax return due if required, or to elect portability for a surviving spouse.

  5. The following April

The final personal income tax return is due; trust income may require its own returns.

  6. Before distribution

Account to the beneficiaries and document their approval (Probate Code §16062).

Connect the estate plan with its administration

A living trust is both an estate planning document and a framework for managing property. The Andrews Law Firm helps Truckee clients consider how the trust will operate during life, during incapacity, and when responsibility passes to a successor trustee. Clear instructions can make the transition easier to understand.

Create instructions people can follow

Your goals guide the provisions for managing and distributing property. We help connect those instructions with trustee selection, continuity, and the assets involved, including how properly held trust property can pass through trust administration.

Review the plan as life changes

New family circumstances or retirement can prompt a trust review. We assist with creation, management questions, and legally available amendments or revocation so the document and the administration remain aligned with the plan’s current purpose.

California rules that apply in Nevada County

The same state law, applied to Truckee property.

Truckee households often combine full-time residents with owners of second homes in neighborhoods such as Tahoe Donner. Truckee is in Nevada County, so a probate or conservatorship for a Truckee resident is generally filed in the Superior Court of California, County of Nevada.

As grieving parents of our deceased son, we were in need of guidance with regard to what do we do next. Our son was without a will and, we had no experience with how to proceed. Luckily, we contacted Elane at the Andrews Law Firm Truckee who immediately understood our situation and was able to provide the information we needed and the necessary legal paperwork to resolve our problem. Our problem was magnified by the fact that we live in Milwaukee and involved my son's car for which we could not find the title. Rather than have to return to Truckee after 40 days to request a new title, Elane assisted us in creating a power attorney for a friend in Truckee which negated our having to return to Truckee from Milwaukee to simply apply for a new title. We are very appreciative with the help we found at The Andres Law Firm Truckee. Thank you, Elaine!

We were referred to Elaine Andrew's law firm through a friend and I'm very happy we went and sat down with her. She quickly recognized a few mistakes in our previous trust and worked to correct them and ensure that our trust followed all legal requirements. We now feel confident that we have a very solid trust for the future.

Elaine was very supportive and professional. She sincerely listened to my concerns and questions. She advised me of California Laws and guided me through the process of what steps would be the best for preparing my will. Kenneth reviewed page by page of my will with me (before signing) and answered all of my questions. I highly recommend The Andrews Law Firm they made my dreaded will preparation bearable. Thank you.

Frequently asked questions

Questions from Truckee families.

What is the difference between creating and administering a trust?
Creation establishes the document and instructions. Administration puts those instructions into practice. The right starting point depends on whether you are planning or managing an existing trust.
I already have a trust. What should I bring?
Bring the complete document, amendments, and an asset list. Explain what has changed and whether you need a planning review or help with administration.
How do I prepare a successor trustee?
Gather the trust, relevant records, and contact information in an organized place. Ask counsel what information and instructions should be reviewed with the person you selected.
Should I review the trust after retirement?
Retirement may change your goals, property, or family priorities. A review can identify questions about the existing instructions and whether an update should be considered.
Does having a trust settle every transfer question?
Review how each asset is owned. Property held outside the trust may require a different process, so bring records rather than assuming one document covers everything.
