A trust can be signed while valuable brokerage assets remain outside it. Review account title, ordinary shares, and compensation-plan restrictions before sending blanket retitling instructions.

Fund eligible accounts without misclassifying equity awards

Brokerage holdings and employer equity arrangements are not always the same kind of asset. The Andrews Law Firm can discuss California trust funding from its Truckee office, subject to availability. Bring the actual statements and plan terms so the review distinguishes transferable ownership from benefits or rights governed by separate documents.

Review your living trust
01

Review each account

Separate taxable assets from special-plan interests.

02

Confirm completion

Retain updated institutional records.

03

Coordinate the designations

Handle retirement and restricted benefits appropriately.

Read what each account actually holds

Identify the registered owner, account type, assets, and any beneficiary arrangement. Ordinary taxable brokerage shares may raise a different funding question from restricted awards, options, retirement accounts, or employer benefits. An institution’s website may display them together without giving them identical legal treatment. Obtain statements and relevant agreements rather than assuming everything under the same login can be transferred to a trust. A clear account-by-account inventory helps avoid both an unfunded asset and an inappropriate attempt to move something governed by special rules.

Coordinate institutional requirements with the operative trust

Provide the full trust and amendments for legal review, then identify what documentation the institution needs to establish the appropriate ownership or designation. Ask how completion will be confirmed. A submitted form or pending request does not prove that the account title changed. Review the relationship between a trust certificate and the actual governing instructions. If more than one trustee must act, the account arrangements should reflect the relevant authority. Keep correspondence and the final records so the successor can see the result without reconstructing every conversation.

Do not treat retirement or employer awards as ordinary retitling

Retirement assets generally require beneficiary coordination rather than casually changing ownership to the living trust. Stock options, RSUs, and restricted awards may be controlled by compensation documents and transfer limits. Obtain employer-plan and tax advice where needed. A trust cannot create rights the owner does not hold or remove a plan’s restrictions merely by listing an award. Distinguish what is being funded now from what needs a beneficiary review or a separate analysis at a future triggering event.

Connect account funding to the rest of the plan

Review the home, other accounts, intended beneficiaries, and successor appointments alongside the brokerage work. A pour-over will can address omissions but may still require probate to transfer property left outside the trust. A later account opening, company change, rollover, or share transfer can create a new gap. Keep a funding checklist that records the asset, recommended action, responsible person, and evidence of completion. Periodic review should confirm the actual title and designation rather than repeat the assumption that signing the trust covered everything.

Keep the funding checklist tied to final statements

A form sent to a brokerage may remain incomplete because of missing documents, a different account type, or another institutional requirement. Retain the response and compare the current statement with the intended ownership. Ask who will address an unresolved request and when the result will be checked. Do not mark the entire relationship funded because one account changed correctly. A separate retirement or equity-plan account may still need a different review. The successor benefits from a record that identifies completed actions and remaining questions. That is more useful than an unchecked instruction sheet suggesting that every asset under the same institution was handled in the same way.

As grieving parents of our deceased son, we were in need of guidance with regard to what do we do next. Our son was without a will and, we had no experience with how to proceed. Luckily, we contacted Elane at the Andrews Law Firm Truckee who immediately understood our situation and was able to provide the information we needed and the necessary legal paperwork to resolve our problem. Our problem was magnified by the fact that we live in Milwaukee and involved my son's car for which we could not find the title. Rather than have to return to Truckee after 40 days to request a new title, Elane assisted us in creating a power attorney for a friend in Truckee which negated our having to return to Truckee from Milwaukee to simply apply for a new title. We are very appreciative with the help we found at The Andres Law Firm Truckee. Thank you, Elaine!

We were referred to Elaine Andrew's law firm through a friend and I'm very happy we went and sat down with her. She quickly recognized a few mistakes in our previous trust and worked to correct them and ensure that our trust followed all legal requirements. We now feel confident that we have a very solid trust for the future.

Frequently asked questions

Questions about fund eligible accounts without misclassifying equity awards

Can I tell the brokerage to put every account into the trust?
A blanket instruction can be inappropriate. Review account types, compensation terms, beneficiary rules, and tax questions before changing ownership.
What proves that the brokerage funding step is complete?
Look for the institution’s confirmation and current ownership records, not just a copy of the submitted request. Ask which final documents should be retained.
