Does the estate qualify?

Three steps decide whether a simplified procedure can replace full probate.

  1. Add up the property that counts

Assets in the decedent’s sole name, with no beneficiary designation or surviving co-owner.

  2. Set aside what doesn’t count

Trust assets, joint tenancy, payable-on-death and beneficiary accounts, property passing to a surviving spouse and registered vehicles (Probate Code §13050).

  3. Compare with the limit

At or under $208,850 (deaths on or after April 1, 2025): an affidavit after 40 days, or a petition for real estate. Over it: probate, unless another exception applies.

A shorter path for qualifying estates

California lets heirs collect property without formal probate when the qualifying estate is $208,850 or less (deaths on or after April 1, 2025). The Andrews Law Firm, P.C. helps Sierraville families confirm eligibility and choose the right procedure.

Does the estate qualify?

The limit counts only certain property. Joint tenancy, payable-on-death and beneficiary-designated assets, and property passing to a surviving spouse, are generally excluded (Probate Code §13050).

The personal property affidavit

Once 40 days have passed since the death, heirs can present an affidavit to banks and other holders to collect personal property (Probate Code §13100).

Real estate in Sierra County

Real property may pass through a petition to determine succession filed in the Superior Court of California, County of Sierra (Probate Code §13151) or, for property of small value, an affidavit filed with the court and recorded with the county recorder (Probate Code §13200).

California rules that apply in Sierra County

The same state law, applied to Sierraville property.

Sierraville is a Sierra Valley community in Sierra County, where ranch and agricultural land is common. Proposition 19's parent-child exclusion covers a family farm as well as a family home, so title and use records deserve review before land passes to the next generation.

As grieving parents of our deceased son, we were in need of guidance with regard to what do we do next. Our son was without a will and, we had no experience with how to proceed. Luckily, we contacted Elane at the Andrews Law Firm Truckee who immediately understood our situation and was able to provide the information we needed and the necessary legal paperwork to resolve our problem. Our problem was magnified by the fact that we live in Milwaukee and involved my son's car for which we could not find the title. Rather than have to return to Truckee after 40 days to request a new title, Elane assisted us in creating a power attorney for a friend in Truckee which negated our having to return to Truckee from Milwaukee to simply apply for a new title. We are very appreciative with the help we found at The Andres Law Firm Truckee. Thank you, Elaine!

We were referred to Elaine Andrew's law firm through a friend and I'm very happy we went and sat down with her. She quickly recognized a few mistakes in our previous trust and worked to correct them and ensure that our trust followed all legal requirements. We now feel confident that we have a very solid trust for the future.

Frequently asked questions

Questions from Sierraville families.

What is the small estate limit in California?
$208,850 in gross value for deaths on or after April 1, 2025. Earlier dates of death use earlier limits.
How long do I have to wait to use the affidavit?
At least 40 days after the death.
Does a Sierraville house count toward the limit?
Yes, unless it passes outside the estate — for example in a trust, in joint tenancy or to a surviving spouse. Real estate in Sierraville often pushes an estate over the limit.
Can a small estate affidavit transfer a house?
Not the personal property affidavit. Real estate requires a petition to determine succession or, for low-value property, a separate affidavit.
What if the estate is over the limit?
Then probate is generally required, unless the assets pass by trust, survivorship or beneficiary designation.
