Probate is the court-supervised process for transferring assets that were not held in a trust, in joint tenancy or with a beneficiary designation. For a Sierraville resident, probate is generally opened in the Superior Court of California, County of Sierra (Probate Code §7051). The Andrews Law Firm, P.C. guides executors and administrators through each stage.

Opening the estate

The process starts with a petition, notice to heirs and a court hearing. If there is a will, the court admits it and appoints the executor; without one, the court appoints an administrator under California’s intestate succession rules.

Inventory, creditors and taxes

The personal representative inventories assets, has non-cash assets appraised by a probate referee, notifies creditors and pays valid claims. Creditors generally have four months after letters issue to file claims (Probate Code §9100).

Distribution and closing

After debts, expenses and taxes are handled, the representative petitions for final distribution. Compensation for the executor and the attorney is set by statute on the estate’s value (Probate Code §10800, §10810).

California rules that apply in Sierra County

The same state law, applied to Sierraville property.

Sierraville is a Sierra Valley community in Sierra County, where ranch and agricultural land is common. Proposition 19's parent-child exclusion covers a family farm as well as a family home, so title and use records deserve review before land passes to the next generation.

As grieving parents of our deceased son, we were in need of guidance with regard to what do we do next. Our son was without a will and, we had no experience with how to proceed. Luckily, we contacted Elane at the Andrews Law Firm Truckee who immediately understood our situation and was able to provide the information we needed and the necessary legal paperwork to resolve our problem. Our problem was magnified by the fact that we live in Milwaukee and involved my son's car for which we could not find the title. Rather than have to return to Truckee after 40 days to request a new title, Elane assisted us in creating a power attorney for a friend in Truckee which negated our having to return to Truckee from Milwaukee to simply apply for a new title. We are very appreciative with the help we found at The Andres Law Firm Truckee. Thank you, Elaine!

We were referred to Elaine Andrew's law firm through a friend and I'm very happy we went and sat down with her. She quickly recognized a few mistakes in our previous trust and worked to correct them and ensure that our trust followed all legal requirements. We now feel confident that we have a very solid trust for the future.

Frequently asked questions

Questions from Sierraville families.

Is probate required for every Sierraville estate?
No. Assets in a funded trust, in joint tenancy or with beneficiary designations pass outside probate, and estates of $208,850 or less may qualify for simplified procedures (deaths on or after April 1, 2025).
Which court handles probate for a Sierraville resident?
Generally the Superior Court of California, County of Sierra, because probate is filed in the county where the person lived at death.
How long does probate take?
Many California probates take a year or longer. The four-month creditor period, court calendars and real estate sales set much of the pace.
How are probate fees calculated?
California sets executor and attorney compensation by statute: 4% of the first $100,000, 3% of the next $100,000, 2% of the next $800,000 and 1% of the next $9 million, each, based on the estate’s value.
Can I serve as executor if I live outside Sierra County?
Yes. California allows an executor who lives elsewhere, although the court may require a bond, and managing local property takes some planning.
