Protection that holds up

Asset protection means structuring ownership, insurance and entities so that a lawsuit or business setback does not reach more than it should. The Andrews Law Firm, P.C. helps Sierraville individuals and business owners review their exposure within California law.

For Sierraville owners

Protection comes in layers.

  • Liability insurance

Homeowner’s, auto and umbrella coverage — the first line against most claims.

  • Business entities

Properly maintained LLCs and corporations keep business risk inside the business.

  • Statutory exemptions

California protects part of your home equity and many retirement accounts.

  • Trusts for heirs

Spendthrift provisions protect what your beneficiaries inherit.

  • Timing

Plan before a claim — transfers made to defeat creditors can be undone.

What California does — and does not — protect

A revocable living trust does not shield assets from your own creditors (Probate Code §18200), and a trust you create for your own benefit offers limited protection (Probate Code §15304). Statutory exemptions protect a portion of home equity and many retirement accounts.

Timing matters

Transfers made to hinder, delay or defraud a creditor can be unwound under California’s voidable transactions law (Civil Code §3439 and following). Planning works best long before any claim.

Layers, not a single document

Liability insurance, properly maintained entities that separate business and personal assets, and trusts that protect what heirs inherit work together.

California rules that apply in Sierra County

The same state law, applied to Sierraville property.

Sierraville is a Sierra Valley community in Sierra County, where ranch and agricultural land is common. Proposition 19's parent-child exclusion covers a family farm as well as a family home, so title and use records deserve review before land passes to the next generation.

As grieving parents of our deceased son, we were in need of guidance with regard to what do we do next. Our son was without a will and, we had no experience with how to proceed. Luckily, we contacted Elane at the Andrews Law Firm Truckee who immediately understood our situation and was able to provide the information we needed and the necessary legal paperwork to resolve our problem. Our problem was magnified by the fact that we live in Milwaukee and involved my son's car for which we could not find the title. Rather than have to return to Truckee after 40 days to request a new title, Elane assisted us in creating a power attorney for a friend in Truckee which negated our having to return to Truckee from Milwaukee to simply apply for a new title. We are very appreciative with the help we found at The Andres Law Firm Truckee. Thank you, Elaine!

We were referred to Elaine Andrew's law firm through a friend and I'm very happy we went and sat down with her. She quickly recognized a few mistakes in our previous trust and worked to correct them and ensure that our trust followed all legal requirements. We now feel confident that we have a very solid trust for the future.

Frequently asked questions

Questions from Sierraville families.

Can I protect assets after I have been sued?
Transfers made after a claim arises are the ones most likely to be reversed. The firm can explain what remains lawful at that stage, but early planning is far more effective.
Does an LLC protect my Sierraville rental property?
A properly formed and maintained LLC can limit liability arising from the property’s operations to the assets inside the LLC. It does not protect against claims based on your own conduct.
Is my retirement account protected?
Many retirement accounts receive substantial protection under federal and California law, although protection for IRAs in California can be limited to amounts reasonably necessary for support (Code of Civil Procedure §704.115).
Can I leave money to my children so their creditors can’t reach it?
A trust with a spendthrift provision can protect an inheritance from a beneficiary’s creditors in many situations (Probate Code §15300 and following).
Is asset protection the same as hiding assets?
No. Lawful asset protection is transparent planning done in advance. Concealing assets or moving them to defeat a known creditor is not.
